Article 2: Applicability
- These general terms and conditions apply to all offers, orders and agreements of Swippyy.nl.
- By placing an order, the customer accepts these conditions.
Article 3: Delivery
- Delivery takes place via DHL or PostNL.
- Delivery time within the Netherlands is 1-2 working days, to other countries 3-5 working days.
- Postage costs:
- Within the Netherlands: €6,45. Free shipping on orders over €59.
- Outside the Netherlands: €9.95.
- Swippyy is not liable for delays caused by the carrier.
- Products remain the property of Swippyy until full payment has been received.
- The risk of loss or damage to the products passes to the customer at the time of delivery.
- If a product is not available, the customer will be informed as soon as possible and an alternative will be offered or the purchase price will be refunded.
Article 4: Payment
- Swippyy offers several payment methods. The available methods are displayed at checkout.
- The order will only be shipped after full payment has been received.
Article 5: Returns and Right of Withdrawal
- Customers have the right to return products within 14 days of receipt without giving any reason (right of withdrawal), provided they are unopened, unused and in their original condition.
- Return costs are the responsibility of the customer.
- If the entire order is returned, the original shipping costs will be refunded. For partial returns, shipping costs will not be refunded.
- For orders over €59 where free shipping is granted, the shipping costs of €6.45 will still be charged if the total amount falls below €59 after returning.
- Return procedure:
- Customer must email a return request to info@swippyy.nl with the order number, the products in question and the reason for return.
- After receiving the return request, the customer will receive instructions for the return.
- Swippyy will refund the purchase amount within 14 days of receiving the returned products.
- Exceptions to the right of withdrawal:
- Products that are specially made to measure or adapted.
- Products that cannot be returned for hygienic reasons if the seal has been broken.
- Cancellation of an order is possible as long as it has not been shipped. Once the order has been shipped, it can no longer be cancelled, but must be returned according to the return procedure. Customers will be informed by email once their order has been shipped.
- A withdrawal form is available upon request by email.
Article 6: Warranty and Legal Liability
- Swippyy does not offer any additional warranty on the products supplied.
- Customers are entitled to a legal guarantee. This means that a product must meet the reasonable expectations that one may have of it.
- Swippyy is not liable for damage caused by incorrect use of the products.
- Swippyy is not liable for indirect damage, such as lost profit or consequential damage, resulting from the use of the products. This limitation does not apply in cases of intent or gross negligence by Swippyy.
Article 7: Force Majeure
- Swippyy is not liable for delays or shortcomings in the performance of the agreement if these are the result of force majeure, such as natural disasters, pandemics, strikes, or other situations beyond the control of Swippyy.
Article 8: Complaints handling
- Complaints can be submitted via info@swippyy.nl.
- Swippyy aims to handle complaints within 5 working days.
- If a complaint is not resolved satisfactorily, the customer can turn to the European ODR (Online Dispute Resolution) platform via ec.europa.eu/consumers/odr .
- Complaints about defects in the delivered product must be reported to Swippyy in writing within 7 days of receipt of the products.
Article 9: Use of cookies
- Swippyy uses cookies and similar technologies to make the website more user-friendly and to analyze visitor behavior.
- By using the website, the customer agrees to the use of cookies.

Article 10: Privacy Policy
- Swippyy processes personal data in accordance with the General Data Protection Regulation (GDPR).
- Data will only be used for processing orders, communication and marketing purposes (if the customer gives permission for this).
- Personal data will not be shared with third parties unless this is necessary for the performance of the agreement (e.g. delivery services).

Article 11: Dispute resolution
- All agreements and disputes are subject to Dutch law.
- Any disputes will be submitted to the competent court in the Netherlands.
- Swippyy reserves the right to change these general terms and conditions. Customers will be notified of this via the website. Changes will not affect existing agreements.

Article 13: Confirmation of order
- After placing an order, the customer will receive a confirmation by email.
- The customer will be kept informed of the progress of the order by email.
Article 14: Change of delivery address
- It is the customer's responsibility to provide a correct shipping address.
- If an order cannot be delivered due to an incorrect address, additional shipping costs will be charged for a redelivery.
- Delivery address changes can be communicated via email or WhatsApp.
